A short note before the legal bit
Hi. We're Sahaje by Samadrita, a small clothing label based in India. Like every shop, we need a set of rules that explain how we sell, ship, accept returns, and what each of us owes the other. We've kept them plain. They are still binding.
Please read this page before you place an order or use any part of our website. By browsing, registering, or buying from us, you are agreeing to these Terms.
(Like trying a garment on for fit — read this once, and you won't need to come back to the changing room.)
1. Definitions

"We", "us", "our", "Sahaje": Sahaje by Samadrita, the operator of the Website, based in India.

"You", "your", "Customer": any person who accesses, browses, or transacts on the Website.

"Website" / "Store": https://www.sahaje.shop and any related pages, mobile views, or sub-domains.

"Product": any garment or accessory offered for sale on the Website.

"Order": a request by you to buy a Product, placed through the Website's checkout.

"Terms": these Terms and Conditions of Sale and Use and any policy referenced in them.

"Payment Partner": Razorpay Software Private Limited, the payment gateway used by the Store.

"Shipping Partner": Shiprocket / Kart Rocket Pvt. Ltd. and the courier service it allocates for any given Order.

"Business Day": Monday to Friday, excluding national or state holidays in India.
2. Your acceptance of these Terms
By using the Website, registering an account, placing an Order, posting a review, or otherwise interacting with us, you confirm that:

you have read, understood, and agree to these Terms and our Privacy Policy;

you are at least 18 years of age and have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872 (or the equivalent law of your country of residence);

if you are buying on behalf of an organisation, you have the authority to bind that organisation to these Terms; and
-
the information you give us is true, current, and complete.
If you do not agree with any part of these Terms, please do not use the Website or place an Order.
3. Who can shop with us
Our Website is open to adults. We do not knowingly sell to, or process the personal data of, anyone under 18 (and not under the age of digital consent applicable to you, if lower in your country). Parents and guardians may, of course, shop on behalf of children — the contract is with the adult.
We may refuse to register an account, accept an Order, or continue to serve any Customer for any lawful reason, including past breaches of these Terms, suspected fraud, abusive behaviour towards our team, or recurring chargebacks.
4. Your account
You may shop as a guest or by creating an account. If you create an account:

one account per person, please — duplicates may be merged or closed.

keep your log-in credentials confidential and let us know promptly if you suspect any unauthorised use of your account.

you are responsible for all activity on your account that occurs before you tell us in writing about any unauthorised use.

we may suspend or close any account that, on reasonable grounds, we believe is being used in breach of these Terms or applicable law.
(Think of your account like a fitting-room key — yours to keep, yours to look after.)
5. Products, descriptions, and fits
We show our Products honestly, but a screen is not a mirror.

Colour: colours on screen depend on your device and lighting. Slight variation between what you see and the Product you receive is normal and is not a defect.

Fabric and finish: our garments may include hand-woven, hand-block-printed, naturally-dyed, or hand-finished elements. Small irregularities in weave, print alignment, dye depth, slubs, and finish are not defects — they are signs of the hand that made it.

Size and measurements: size charts are a guide. Please measure carefully before ordering. Fit issues arising solely from a wrong size choice are not a defect.

Made-to-order and custom items: any Product marked "made-to-order", "made-to-measure", "custom", "pre-order", or "final sale" is non-returnable and non-refundable except where the Product is defective or differs materially from the Product you ordered. The applicable lead time will be shown on the product page.

Stock: stock indications on the Website are an estimate. A Product may sell out between the time it is added to your cart and the time you complete checkout.
6. Pricing, taxes, and currency
Prices are shown in Indian Rupees (INR) and, for convenience, in United States Dollars (USD). The USD price is a working estimate based on the prevailing reference rate; the Order is concluded in INR unless we expressly confirm otherwise.
Taxes (India): prices include GST where applicable, unless stated. If GST or any other tax rate changes between the time you place an Order and the time we accept it, we will charge the rate applicable on the date of invoice.
Customs duties, import taxes, and local levies (international Orders): import duties, customs charges, foreign-exchange conversion costs, and any local taxes on delivery in your country are payable by you, not by Sahaje. We are not the importer of record. If a parcel is refused at customs or returned to us for non-payment of import dues, we may treat the Order as cancelled at your cost and refund the Product price less shipping, handling, and any forwarding charges actually incurred.
Mispricing: we take care with prices, but mistakes happen. If a Product is mistakenly listed at an incorrect price (for example, a clear typographical error, a missing decimal, or a price obviously below cost), we may refuse or cancel the Order even after Order confirmation but before dispatch, and refund any amount you paid. We are not bound to supply at the incorrect price.
7. Placing an Order, our acceptance, and dispatch
Placing an Order through checkout is your offer to buy. The auto-generated confirmation email or on-screen confirmation acknowledges receipt of your offer — it is not our acceptance.
When the contract is formed: a binding contract of sale is formed only when we dispatch the Product to you. Until then, we may refuse or cancel the Order, in whole or in part, for any lawful reason, including (without limitation) unavailability of stock, suspected fraud, declined payment, mispricing, geographic non-serviceability, or breach of these Terms. We will refund any amount you paid for the cancelled portion within the timelines in Section 12.
Estimated dispatch times: our dispatch estimates are shown on each product page (and, generally, are within 3 to 10 Business Days for in-stock items and as indicated for made-to-order items). These are estimates, not guarantees.
8. Payment
Payment is processed through our Payment Partner, Razorpay, on its own secure (PCI-DSS compliant) systems. We do not see, store, or process your full card number, CVV, or net-banking credentials.
Accepted methods are those shown at checkout (which may include UPI, debit/credit cards, net-banking, wallets, and EMI for eligible cards). Cash-on-delivery is offered only for certain Indian pin-codes, in our discretion, and may be withdrawn at any time.
Authorisation and capture: placing an Order authorises the Payment Partner to capture the relevant amount from your payment instrument. If the payment fails or is reversed, we may cancel the Order and notify you.
Chargebacks: you agree to attempt to resolve any payment dispute with us first, before raising a chargeback with your bank. Unjustified chargebacks may result in account suspension, refusal of future Orders, and recovery of our reasonable costs.
9. Shipping, delivery, and risk
Domestic shipping (India): we ship across India through Shiprocket and its courier partners. Standard delivery is usually 3 to 10 Business Days after dispatch, depending on pin-code. Remote pin-codes may take longer.
International shipping: available on request and only to countries we then service. Transit times vary by destination and courier, typically 7 to 21 Business Days after dispatch. International shipping fees, customs duties, import taxes, and similar charges are payable by you (see Section 6).
Risk of loss and title: subject to applicable consumer-protection law, risk of loss in the Product passes to you on hand-over by us to the Shipping Partner. Title passes to you on full payment and delivery, whichever is later.
Wrong or incomplete addresses: we ship to the address you provide at checkout. If the address is wrong or incomplete, or the consignee is not available to receive the parcel, and the parcel is returned to us, you are responsible for additional shipping and handling charges for any re-dispatch. We may instead, at your option, refund the Product price after deducting these costs.
Delivery exceptions: after dispatch, parcels are in the hands of the Shipping Partner. We are not liable for delays caused by the Shipping Partner, the courier, customs authorities, weather, strikes, civil disturbances, government action, or other matters outside our reasonable control. We will help you track and chase a parcel where reasonably possible.

10. Cancellation by you
You may cancel an Order before it is dispatched by writing to chakrabartisnil@gmail.com from the email address used for the Order. Cancellation requests received after dispatch cannot be honoured; please follow the returns process in Section 11 instead.
Cancellation of made-to-order, made-to-measure, custom, or pre-order items is not possible once production has started. The product page will indicate the cut-off.
Where a cancellation is accepted, refunds are processed under Section 12.
11. Returns, exchanges, and defective Products
(We stand behind our seams.)
11.1 What you may return
You may request a return or exchange of an eligible, unworn, unwashed, unaltered Product in its original condition, with all tags, labels, and packaging intact, within 7 calendar days of delivery. The Product must show no signs of wear, dirt, perfume, deodorant, body or hair oil, smoke, or pet hair.
11.2 What you cannot return

Made-to-order, made-to-measure, custom, pre-order, or items expressly marked "final sale" or "non-returnable" on the product page.

Innerwear, lingerie, swimwear, masks, and any other item that, for hygiene or safety reasons, is not eligible for return.
-
Sale items, unless the Product is defective or differs materially from what you ordered.
-
Accessories that have been used, opened beyond inspection, or had their security seals broken.
11.3 Defective or wrong Products
If a Product is defective or differs materially from the Product you ordered, please write to chakrabartisnil@gmail.com within 7 calendar days of delivery, with the Order number, photographs of the issue, and a short description. If we are satisfied the Product is defective or wrong, we will, at our option: replace it, exchange it for another Product of equal or lesser value, or refund the amount you paid. Nothing in this section limits any non-excludable statutory right you have under the Consumer Protection Act, 2019 or any other applicable law.
11.4 How to return

Write to chakrabartisnil@gmail.com with the Order number and reason for return.

Wait for our confirmation and return instructions. Returns sent without prior confirmation may be refused.

Pack the Product securely in its original packaging.

For Indian Orders, we may arrange a reverse pick-up through Shiprocket (subject to pin-code serviceability). For international Orders, you are responsible for arranging and paying for the return shipment to the address we provide.

Once we receive the Product, we will inspect it within 5 Business Days. If it passes inspection, we will process the refund or exchange under Section 12.
11.5 Reverse-pick-up and return shipping charges
For domestic Orders, where a reverse pick-up is available and the return is on account of a defect or our error, return shipping is free. For other accepted returns (for example, a change of mind), a reverse-shipping and restocking charge of up to INR 200 per Product, or 5% of the Product price, whichever is higher, may be deducted from the refund.
For international Orders, return shipping is paid by you in all cases.
12. Refunds
Where a refund is due, we will process it within 7 Business Days of (a) accepting a cancellation, (b) accepting a defective/wrong-Product claim, or (c) inspecting and accepting a returned Product. The bank or wallet may take a further 5 to 10 Business Days to credit the amount.
How refunds are made: refunds are credited to the original payment instrument. Where that is not possible (for example, the card has expired), we will work with you on a reasonable alternative, such as bank transfer to a verified account in your name.
Deductions: refunds are net of any shipping or handling charges actually incurred (other than where the law requires us to refund those, such as defective Products), and any restocking charge under Section 11.5.
Currency: INR Orders are refunded in INR. For international Orders paid in USD, the refund is processed in INR equivalent at the rate at the time of refund; foreign-exchange differences between payment and refund are not our responsibility.
No refund in cash: regardless of the payment mode used (including cash-on-delivery), refunds are processed digitally, not in cash.
13. Acceptable use of the Website
You agree not to:

use the Website for any unlawful purpose or in a way that violates these Terms;

scrape, crawl, harvest, copy, or systematically retrieve any content, images, designs, prices, or data from the Website, including for the purpose of training any machine-learning model, except for personal, non-commercial browsing;

reverse-engineer or attempt to extract the source code or underlying ideas of the Website;
-
introduce any virus, worm, trojan horse, or other malicious code, or attempt to gain unauthorised access to any part of the Website or any related system;
-
place Orders by automated means, use bots to monitor stock, or use multiple accounts to circumvent purchase limits or anti-fraud checks;
-
impersonate another person, misrepresent your affiliation, or use a payment instrument that is not lawfully yours to use;
-
upload or post content that is unlawful, defamatory, obscene, infringing, or hateful, or that violates anyone's privacy or other rights;
-
resell, redistribute, or commercially exploit any Product, content, or Website feature without our prior written consent;
-
interfere with the working of the Website, its security, or its rate limits.
14. Our intellectual property
All rights in and to the Website, the Products, the brand name "Sahaje by Samadrita", the Sahaje logo, the look and feel of the Website, our product designs, our product photography, our model photography, our written content, our packaging design, our patterns, our prints, and our colour combinations are owned by Sahaje by Samadrita or licensed to us, and are protected by Indian copyright, trademark, and design laws and equivalent laws in other countries.
Limited licence: we give you a limited, revocable, non-exclusive, non-transferable, non-sub-licensable licence to access and use the Website for the sole purpose of browsing and placing Orders for your personal, non-commercial use. Nothing else is licensed.
What you may not do: you may not copy, reproduce, distribute, republish, download, display, post, transmit, frame, mirror, or create derivative works of our content; use our photography for resale, advertising, or any commercial purpose; or apply our trademarks, designs, or get-up to any goods or services, in any case without our prior written permission. Any unauthorised use ends the limited licence above automatically.
(Borrowed inspiration is fine. Borrowed seams are not.)
15. Reviews, photos, and other content you post
If you post a review, photograph, video, tag, comment, or any other content on the Website or on our social-media pages, or tag us on social media ("User Content"), you confirm that:

you own or have all necessary rights in the User Content;

the User Content is accurate, lawful, and does not infringe anyone's intellectual property, privacy, publicity, or other rights;
-
any people shown in the User Content have consented to that use; and
-
the User Content is not abusive, defamatory, obscene, hateful, or otherwise objectionable.
Your licence to us: you grant Sahaje a worldwide, royalty-free, sub-licensable, transferable, non-exclusive licence to use, host, reproduce, modify (for cropping, colour adjustment, captioning, and format conversion only), publish, distribute, and display the User Content on the Website, in our marketing channels (including social media, newsletters, and advertising), and in our business operations. This licence lasts for as long as we use the User Content, and is granted on a perpetual basis only to the extent required by applicable law for commercial fair use of customer reviews; you can withdraw consent to use a specific User Content item by writing to chakrabartisnil@gmail.com, and we will stop using that item in new placements within a reasonable time (existing print or scheduled placements may take longer to remove).
Moderation: we may, but are not obliged to, moderate, edit (for length or clarity only), or remove any User Content. We are not the author of User Content posted by others and do not endorse it.
16. Promotions, vouchers, and discount codes
Promotional offers, vouchers, gift cards, and discount codes are subject to any specific terms shown alongside them. Unless stated otherwise:

one code per Order; codes are not combinable;

codes have no cash value and are not transferable;
-
codes may be withdrawn or revoked if abused (for example, repeated cancellation to re-use a single-use code);
-
we may exclude certain Products (for example, new launches, collaborations, or already-discounted items) from any promotion.
17. Force majeure
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including: acts of God, fire, flood, earthquake, storm, lightning, cyclone, pandemic, epidemic, public-health emergency, war, terrorism, riot, civil disturbance, strike, lock-out, embargo, sanctions, change in law or regulation, government order, internet or telecommunications failure, hosting-platform or payment-gateway outage, courier disruption, customs delay, or shortage of materials or labour. Performance is suspended for the duration of the force-majeure event and resumes promptly thereafter.
18. Warranties and disclaimers
We provide the Website and the Products with reasonable care.
To the maximum extent permitted by law, the Website is provided on an "as-is" and "as-available" basis without any warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, or uninterrupted operation. We do not warrant that the Website will be free of bugs, errors, or vulnerabilities, or that any content is up to date.
Nothing in these Terms excludes or limits any non-excludable statutory right you have under the Consumer Protection Act, 2019, the Sale of Goods Act, 1930, or any equivalent law that protects you as a consumer.
19. Limitation of liability
Cap: subject to the next paragraph, our total aggregate liability to you, whether in contract, tort (including negligence), under statute, or otherwise, arising out of or in connection with these Terms, the Website, or any Order, is limited, in respect of any single Order, to the amount actually paid by you for that Order; and in respect of any other liability, to INR 5,000 (Indian Rupees Five Thousand).
Exclusions: we are not liable for: loss of profits, loss of revenue, loss of business, loss of goodwill, loss of expected savings, loss of data, loss of opportunity, any indirect, special, incidental, consequential, exemplary, or punitive loss or damage, however arising, even if the possibility was made known to us in advance.
What this section does not limit: nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded under Indian law, including liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any non-excludable statutory liability under the Consumer Protection Act, 2019.
20. Indemnity
You agree to indemnify and hold harmless Sahaje by Samadrita and its founders, employees, contractors, and service providers from and against any third-party claim, demand, loss, damage, liability, cost, or expense (including reasonable legal fees) arising out of or in connection with: (a) your breach of these Terms; (b) your misuse of the Website; (c) your User Content; (d) your infringement of any third party's rights; or (e) your violation of any applicable law. We will tell you promptly about any claim and let you take over its defence if you wish, in cooperation with us, provided you do not settle any claim in a way that admits fault on our part without our prior written consent.
21. Suspension and termination
We may suspend or terminate your access to all or part of the Website, your account, or any Order, at any time, with or without notice, where we reasonably believe that:

you have breached these Terms;

we are required to do so by law or by a competent authority;

there is suspected fraud, money-laundering, sanctions exposure, or other unlawful activity in connection with your use; or
-
continued service is technically or commercially infeasible.
Termination does not affect any rights or obligations that have already accrued (for example, payment for Orders already dispatched). Sections 14 (IP), 15 (User Content licence), 18 (Disclaimers), 19 (Liability), 20 (Indemnity), 22 (Governing law), and 23 (Dispute resolution) survive termination.
22. Governing law and jurisdiction
These Terms, your use of the Website, and any Order are governed by the laws of India, without regard to its conflict-of-laws principles. Subject to Section 23, the courts within whose territorial jurisdiction the principal place of business of Sahaje by Samadrita in India is situated shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, except that you may bring any claim that you are entitled, by non-excludable consumer-protection law, to bring before a consumer forum or court at your place of residence.
23. Dispute resolution
Step 1 — Talk to us first. Most issues can be sorted out by writing to chakrabartisnil@gmail.com. We will acknowledge your message within 7 working days and respond on the substance within 30 calendar days.
Step 2 — Grievance Officer (Consumer Protection (E-Commerce) Rules, 2020). If our first response does not resolve your concern, you may escalate to our Grievance Officer at the same email address, marked "Grievance: Sahaje Order [order number]". The Grievance Officer will acknowledge within 48 hours and respond on the substance within 30 days, in line with the said Rules.
Step 3 — Mediation or consumer forum. If the matter is still unresolved, you may approach a competent consumer disputes redressal commission under the Consumer Protection Act, 2019, or any other competent forum.
Optional arbitration (commercial disputes only). For any commercial dispute that is not eligible for a consumer forum, the parties may agree in writing to refer the dispute to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be the city of our principal place of business in India; the language shall be English. Nothing in this paragraph deprives you of your rights as a consumer to use a consumer forum.
24. Changes to these Terms
We may update these Terms from time to time. The current version, with its Effective Date, will always be at the same URL on the Website. If a change is material (it changes your rights, our liability, the dispute mechanism, or the price of a Product you have already ordered), we will give at least 7 calendar days' notice on the Website or by email before the change takes effect, except where the law requires an immediate change.
Orders placed before the new version takes effect are governed by the version of the Terms in force when you placed the Order.
25. Grievance Officer and notices
For grievances under the Consumer Protection (E-Commerce) Rules, 2020 and the Information Technology Act, 2000, the contact details of our Grievance Officer are:

Notices to us are validly given when sent to the email address above. Notices to you are validly given when sent to the email address associated with your account or your Order.
26. Other legal points
Entire agreement: these Terms, together with our Privacy Policy and any policy specifically incorporated by reference (for example, a sale-event-specific terms page), are the entire agreement between you and us about the subject matter, and replace any earlier understanding.
Severability: if any part of these Terms is found to be unlawful, invalid, or unenforceable, that part will be modified to the minimum extent needed to make it valid, or struck out, while the rest will stay in force.
No waiver: if we do not enforce a right or remedy under these Terms on any occasion, that is not a waiver of that right or remedy for any other occasion.
Assignment: we may assign or transfer our rights and obligations under these Terms to any successor in our business or to a group affiliate, subject to the new entity being bound by the same Privacy Policy. You may not assign or transfer your rights or obligations without our prior written consent.
No partnership or agency: nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and us.
Third-party rights: no one other than you and us has any right to enforce these Terms.
Headings: section headings are for convenience only and do not affect the meaning of these Terms.
Language: these Terms are in English. Any translation we may provide is for convenience only and the English text shall prevail in case of conflict, except where the law of your country of residence provides otherwise.
Counterparts / electronic acceptance: these Terms are accepted electronically when you tick a check-box, click a button, or otherwise interact with the Website in the ways described in Section 2.
