Terms and Conditions of Sale and Use

Welcome to Sahaje by Samadrita. These Terms explain how we sell, ship, accept returns and operate our Website. By browsing, registering or placing an Order, you agree to these Terms and our Privacy Policy.

Sahaje by Samadrita (“Sahaje”, “we”, “us” or “our”) operates the Website www.sahaje.shop. “You” means any person using or purchasing through the Website. “Product” means any garment or accessory offered for sale, and “Order” means a request to purchase a Product through checkout. Payments are processed through Razorpay and shipping may be handled through Shiprocket and its courier partners.

You must be at least 18 years old and legally capable of entering into a contract to place an Order. Information supplied by you must be accurate and current. We may refuse or suspend accounts or Orders where reasonably necessary because of fraud, misuse, abusive behaviour, repeated chargebacks or breach of these Terms.

You may shop as a guest or create an account. If you create an account, you are responsible for keeping your login details secure and for activity occurring through your account until you inform us of unauthorised access.

We try to describe and display Products accurately, but colours may vary depending on screens and lighting. Handwoven, hand-dyed, hand-printed or handcrafted Products may contain small variations in weave, colour, print or finish, which are not defects. Size charts are guides and customers should check measurements before ordering. Made-to-order, customised, pre-order and final-sale Products are non-returnable unless defective or materially different from what was ordered.

Prices are displayed primarily in INR and may also be shown in USD for convenience. Applicable Indian taxes are included or charged as stated at checkout. International customers are responsible for customs duties, import taxes, foreign-exchange charges and similar levies. Where an obvious pricing error occurs, we may cancel the Order before dispatch and refund the amount paid.

Placing an Order is an offer to purchase. An automated confirmation only confirms receipt of that offer. The sale contract is formed when we dispatch the Product. Before dispatch, we may cancel an Order for reasons such as stock unavailability, payment failure, suspected fraud, pricing error, non-serviceability or breach of these Terms, in which case applicable amounts paid will be refunded.

Payment is processed securely through Razorpay. We do not store full card numbers, CVVs or net-banking credentials. Available payment methods are shown at checkout. Cash on delivery may be available for selected Indian pin codes. Customers should first contact us regarding payment disputes before initiating a chargeback.

Domestic Orders are generally delivered within 3 to 10 Business Days after dispatch, depending on location. International delivery may generally take 7 to 21 Business Days after dispatch. Delivery periods are estimates and may be affected by courier delays, customs, weather, strikes, government action or other circumstances outside our reasonable control.

You are responsible for providing a correct delivery address and ensuring that someone is available to receive the parcel. If a parcel is returned because of an incorrect address, failed delivery or refusal to pay applicable customs charges, reasonable shipping and handling costs may be deducted from any refund or charged for re-dispatch.

Orders may generally be cancelled before dispatch by contacting chakrabartisnil@gmail.com. Once dispatched, the return process applies instead. Made-to-order, customised or pre-order Products cannot be cancelled after production has started.

Eligible Products may be returned or exchanged within 7 calendar days of delivery if they are unused, unworn, unwashed, unaltered and returned with their tags and packaging intact. Products showing signs of wear, perfume, deodorant, oil, smoke, dirt or similar use may be refused.

Made-to-order, customised, pre-order, final-sale, hygiene-sensitive and certain sale Products are generally non-returnable unless defective or materially different from what was ordered.

If you receive a defective or incorrect Product, contact us within 7 calendar days of delivery with your Order number, photographs and a description of the issue. Where the claim is accepted, we may replace the Product, exchange it or issue a refund. Nothing in these Terms limits rights that cannot lawfully be excluded under applicable consumer law.

For a return, contact chakrabartisnil@gmail.com and wait for return instructions before sending the Product. Indian reverse pickup may be arranged where serviceable. International customers must normally arrange and pay for return shipping. Returned Products will be inspected before a refund or exchange is approved.

Where the return results from our error or a defect, domestic reverse shipping will ordinarily be free. For other accepted domestic returns, we may deduct a reverse-shipping and restocking charge of up to INR 200 per Product or 5% of the Product price, whichever is higher.

Approved refunds are normally processed within 7 Business Days. Your bank or payment provider may take additional time to credit the amount. Refunds are generally made to the original payment method and may be reduced by legitimate shipping, handling or return charges where permitted by law.

You must not misuse the Website, attempt unauthorised access, introduce malicious software, scrape or systematically copy its content, use bots to place Orders or monitor stock, impersonate another person, misuse payment instruments, upload unlawful material or commercially exploit our Website or content without permission.

The Sahaje name, logo, Website content, product designs, photographs, written material, packaging, patterns, prints and other intellectual property belong to Sahaje or its licensors and are protected by applicable intellectual-property laws. You may use the Website only for personal browsing and purchasing. You may not reproduce, distribute, commercially use or create derivative works from our content without written permission.

If you submit reviews, photographs, videos, comments or similar content, you confirm that you have the necessary rights and that the content is lawful and does not violate another person's rights. You grant Sahaje a non-exclusive, royalty-free licence to use such content for the Website, marketing and business communications. You may ask us to stop using specific content in future placements by contacting us.

Promotional codes, vouchers and offers may have additional terms. Unless otherwise stated, only one code may be used per Order, codes have no cash value, certain Products may be excluded, and promotions may be withdrawn where they are abused.

We are not responsible for delay or failure caused by circumstances beyond our reasonable control, including natural disasters, pandemics, war, civil disturbance, strikes, regulatory action, internet or payment outages, courier disruption, customs delay or material shortages.

The Website and Products are provided with reasonable care. To the maximum extent permitted by law, we do not guarantee uninterrupted Website availability or that all content will always be error-free or current. Nothing in these Terms excludes rights that cannot lawfully be excluded under the Consumer Protection Act, 2019, the Sale of Goods Act, 1930 or other applicable law.

Subject to non-excludable legal rights, our liability relating to an Order will ordinarily not exceed the amount paid for that Order. For other claims relating to use of the Website, liability will ordinarily not exceed INR 5,000. We are not liable for indirect or consequential commercial losses where such exclusion is legally permitted. These limitations do not apply to fraud, fraudulent misrepresentation or other liability that cannot lawfully be excluded.

You agree to compensate Sahaje for reasonable losses arising from your breach of these Terms, unlawful misuse of the Website, infringement of third-party rights or unlawful User Content, subject to applicable law.

We may suspend access to the Website, an account or an Order where we reasonably believe these Terms have been breached, unlawful activity is suspected, action is legally required or continued service is technically or commercially impracticable.

These Terms and all Orders are governed by Indian law. Subject to applicable consumer rights, disputes will ordinarily be subject to the courts having jurisdiction over Sahaje's principal place of business. Consumers may continue to approach any consumer forum or court available to them under applicable law.

If you have a complaint, contact chakrabartisnil@gmail.com. We will acknowledge complaints within 7 working days and aim to provide a substantive response within 30 calendar days. Consumer grievances may be escalated to the Grievance Officer at the same email address, marked “Grievance: Sahaje Order [Order number]”. Nothing prevents a consumer from approaching a competent Consumer Disputes Redressal Commission or other lawful forum. Commercial disputes may be referred to arbitration only where both parties separately agree in writing.

We may update these Terms from time to time. The current version and Effective Date will be displayed on the Website. Material changes affecting existing rights or obligations will normally be notified in advance unless immediate changes are required by law. Orders already placed remain governed by the Terms applicable when the Order was placed.

These Terms, together with the Privacy Policy and any specific terms incorporated into them, constitute the agreement between you and Sahaje regarding use of the Website and Orders. If any provision is held invalid, the remaining provisions will continue to apply.

These Terms are written in English. Any translation is provided for convenience, and the English version will prevail to the extent permitted by applicable law.
